AKPS chief Mohd Shuhaily pleads not guilty to assaulting two Special Branch officers at KLIA, granted RM3,000 total bail

SEPANG, Oct 21 — Director-General of the Malaysia Border Control and Protection Agency (AKPS), Datuk Seri Mohd Shuhaily Mohd Zain, pleaded not guilty at the Magistrate’s Court here today to two charges of voluntarily causing hurt to two Special Branch police officers at Kuala Lumpur International Airport (KLIA) Terminal 1.

Appearing before Magistrate Norisda Nora Binti Mahmud, Shuhaily, 53, claimed trial to both charges framed under Section 323 of the Penal Code, which carries a maximum penalty of one year’s imprisonment, a fine of up to RM2,000, or both upon conviction.

The court granted bail set at RM1,500 with one surety for each charge, bringing total bail to RM3,000, and scheduled November 25, 2026, for case mention (sebutan semula kes).

Defence team highlights legal nature of Section 323

Speaking to reporters outside the courtroom following the proceedings, lead counsel representing Shuhaily confirmed that bail was posted smoothly and emphasized the legal framework governing the case.

“Alhamdulillah, the charging and bail process has been completed smoothly with bail set at RM1,500 per charge,” the defence counsel said. “We are grateful that a strong line-up of legal colleagues, schoolmates, and long-time professional friends came forward to support Datuk Seri Shuhaily.”

“Under Section 323 of the Penal Code, this is a compoundable, non-seizable offense (OKS/orang kena saman). While the law provides for penalties including potential imprisonment, it is categorized as a minor offense (petty offense). Under the law, an accused person is presumed innocent until proven guilty.”

Shuhaily addresses ‘unseen recording’ and police reports

In separate footage recorded prior to his court appearance regarding the underlying KLIA incident, Shuhaily revealed that the confrontation stemmed from unauthorized individuals recording an internal interview between AKPS officers and foreign nationals in a restricted zone.

“Inside that room, there should have only been AKPS and AVSEC (Aviation Security) personnel,” Shuhaily stated. “Without our knowledge while I was interviewing foreign nationals, two unfamiliar individuals appeared and began recording our operations. My officers approached them, brought them forward, and upon inspecting what was recorded, instructions were given to delete the footage.”

Shuhaily noted that he issued a stern warning in his capacity as a senior police commander. However, he pointed out that two police reports were lodged against him following the incident, including one filed at 5:00 AM on September 30.

“This prompted my team and I to lodge a police report indicating that there may be attempts to tarnish the image of AKPS generally, and my personal reputation specifically,” Shuhaily added.

“I have informed the highest levels of government and the ministry. Whatever their decision, I accept it. To change something comes at a price, and if that price is myself, I am willing to pay it. I own up to my imperfections and leave the matter to full investigation so that justice will prevail for all parties.”

Defence lawyers confirmed that Shuhaily will continue executing his official duties as AKPS Director-General pending further administrative or judicial instructions.
